1. Data Protection at a Glance
General information
The following information provides a simple overview of what happens to your personal data when you visit this website or contact us. Personal data is any data by which you can be personally identified. Detailed information on the subject of data protection can be found in the privacy policy below.
Data collection on this website
Who is responsible for data collection on this website?
Data processing on this website is carried out by the website operator. Its contact details can be found in the section “Information on the controller” in this privacy policy.
How do we collect your data?
On the one hand, your data is collected when you provide it to us, e.g. in an inquiry by e-mail or telephone.
Other data is collected automatically or with your consent by our IT systems when you visit the website. This is mainly technical data (e.g. internet browser, operating system or time of the page view).
What do we use your data for?
Part of the data is collected to ensure error-free provision of the website. Other data is used to process your inquiries and orders or to analyse website usage. Inquiries concerning products distributed by our sister company EQ Photonics GmbH are forwarded to it (see Section 7).
What rights do you have regarding your data?
You have the right at any time to receive information free of charge about the origin, recipients and purpose of your stored personal data. You also have the right to request the rectification or erasure of this data. If you have given consent to data processing, you can revoke this consent at any time with effect for the future. You also have the right, under certain circumstances, to request the restriction of the processing of your personal data. Furthermore, you have the right to lodge a complaint with the competent supervisory authority.
You can contact us at any time regarding this and any other questions on the subject of data protection.
2. Hosting
We host our website with STRATO GmbH, Otto-Ostrowski-Straße 7, 10249 Berlin, Germany (hereinafter: host). When you visit our website, the host collects various log files including your IP addresses. For details, please refer to the host’s privacy policy: https://www.strato.de/datenschutz/.
The host is used on the basis of Art. 6(1)(f) GDPR. We have a legitimate interest in the most reliable presentation possible of our website.
Data processing agreement
We have concluded a data processing agreement (DPA) with the host. This ensures that the host processes the personal data of our website visitors only in accordance with our instructions and in compliance with the GDPR.
3. General Information and Mandatory Disclosures
Data protection
We take the protection of your personal data very seriously. We treat your personal data confidentially and in accordance with the statutory data protection regulations and this privacy policy.
Please note that data transmission over the internet (e.g. when communicating by e-mail) may be subject to security vulnerabilities. Complete protection of data against access by third parties is not possible.
Information on the controller
The controller responsible for data processing is:
FLC – Frankfurt Laser Company GmbH
An den 30 Morgen 13
61381 Friedrichsdorf, Germany
Phone: +49 (0)6172 27978-0
E-mail: sales@frlaserco.com
The controller is the natural or legal person who alone or jointly with others determines the purposes and means of the processing of personal data (e.g. names, e-mail addresses, etc.).
Storage period
Unless a more specific storage period is stated in this privacy policy, your personal data will remain with us until the purpose for the data processing no longer applies. If you assert a legitimate request for erasure or revoke your consent to data processing, your data will be deleted unless we have other legally permissible reasons for storing it (e.g. retention periods under tax or commercial law); in the latter case, the data will be deleted once these reasons cease to apply.
Revocation of your consent to data processing
Many data processing operations are only possible with your express consent. You can revoke consent you have already given at any time. The lawfulness of the data processing carried out until the revocation remains unaffected by the revocation.
Right to object to data collection in special cases and to direct marketing (Art. 21 GDPR)
IF DATA PROCESSING IS BASED ON ART. 6(1)(E) OR (F) GDPR, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF YOUR PERSONAL DATA ON GROUNDS RELATING TO YOUR PARTICULAR SITUATION; THIS ALSO APPLIES TO PROFILING BASED ON THESE PROVISIONS. THE RESPECTIVE LEGAL BASIS ON WHICH PROCESSING IS BASED CAN BE FOUND IN THIS PRIVACY POLICY. IF YOU OBJECT, WE WILL NO LONGER PROCESS YOUR PERSONAL DATA CONCERNED UNLESS WE CAN DEMONSTRATE COMPELLING LEGITIMATE GROUNDS FOR THE PROCESSING WHICH OVERRIDE YOUR INTERESTS, RIGHTS AND FREEDOMS, OR THE PROCESSING SERVES THE ESTABLISHMENT, EXERCISE OR DEFENCE OF LEGAL CLAIMS (OBJECTION UNDER ART. 21(1) GDPR).
IF YOUR PERSONAL DATA IS PROCESSED FOR THE PURPOSE OF DIRECT MARKETING, YOU HAVE THE RIGHT TO OBJECT AT ANY TIME TO THE PROCESSING OF PERSONAL DATA CONCERNING YOU FOR THE PURPOSE OF SUCH MARKETING; THIS ALSO APPLIES TO PROFILING TO THE EXTENT THAT IT IS RELATED TO SUCH DIRECT MARKETING. IF YOU OBJECT, YOUR PERSONAL DATA WILL SUBSEQUENTLY NO LONGER BE USED FOR THE PURPOSE OF DIRECT MARKETING (OBJECTION UNDER ART. 21(2) GDPR).
Right to lodge a complaint with the competent supervisory authority
In the event of breaches of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, their place of work or the place of the alleged breach. The right to lodge a complaint is without prejudice to any other administrative or judicial remedy.
Right to data portability
You have the right to have data that we process automatically on the basis of your consent or in performance of a contract handed over to you or to a third party in a common, machine-readable format. If you request the direct transfer of the data to another controller, this will only be done to the extent technically feasible.
Information, erasure and rectification
Within the framework of the applicable statutory provisions, you have the right at any time to free information about your stored personal data, its origin and recipients and the purpose of the data processing and, if applicable, a right to rectification or erasure of this data.
Right to restriction of processing
You have the right to request the restriction of the processing of your personal data. This right exists in particular,
- as long as we are verifying the accuracy of your data stored by us which you dispute,
- if the processing is unlawful and you request restriction instead of erasure,
- if we no longer need your data but you need it for the exercise, defence or establishment of legal claims,
- as long as, after an objection under Art. 21(1) GDPR, it has not yet been determined whose interests prevail.
If you have restricted the processing of your personal data, this data may – apart from being stored – only be processed with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of important public interest of the European Union or a Member State.
SSL or TLS encryption
For security reasons and to protect the transmission of confidential content, this site uses SSL or TLS encryption. You can recognise an encrypted connection by the fact that the address line of the browser changes from “http://” to “https://” and by the lock symbol in your browser line.
4. Data Collection on this Website
Cookies
Our website uses so-called “cookies”. Cookies are small text files that are stored on your device and do not cause any damage. They are stored either temporarily for the duration of a session (session cookies) or permanently (persistent cookies). Session cookies are automatically deleted at the end of your visit; persistent cookies remain stored until you delete them yourself or your browser deletes them automatically.
We set technically necessary cookies on the basis of Section 25(2) of the German Telecommunications Digital Services Data Protection Act (TDDDG) and Art. 6(1)(f) GDPR; we have a legitimate interest in the technically error-free provision of our website. All other cookies, in particular for analysis purposes, are only set with your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR). Consent can be revoked at any time with effect for the future.
You can set your browser so that you are informed about the setting of cookies, allow cookies only in individual cases or exclude them in general. If cookies are deactivated, the functionality of this website may be restricted.
Consent management
To obtain and document your consents, we use the consent tool “Real Cookie Banner”, provider: devowl.io GmbH, Tannet 12, 94539 Grafling, Germany. The tool runs on our own server; your consents or their revocation are stored in a cookie in your browser and are not transmitted to the provider. The legal basis is Art. 6(1)(c) GDPR, as we are legally obliged to be able to prove consents. You can change your selection at any time via the “Cookie settings” link in the footer of our website.
Server log files
The host of this website automatically collects and stores information that your browser transmits. This is:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources. The collection is based on Art. 6(1)(f) GDPR; we have a legitimate interest in the technically error-free presentation and the security of our website.
Inquiries by e-mail, telephone or contact form
If you contact us by e-mail, telephone, contact form or at a trade fair, we store and process your inquiry including the personal data resulting from it (name, position, company, contact details, content of the inquiry) for the purpose of processing it.
Processing is based on Art. 6(1)(b) GDPR if your inquiry is related to the performance of a contract or is necessary for the implementation of pre-contractual measures. In all other cases, processing is based on our legitimate interest in the effective handling of inquiries addressed to us (Art. 6(1)(f) GDPR).
The data remains with us until you request its erasure, revoke your consent or the purpose for data storage no longer applies. Mandatory statutory provisions, in particular retention periods, remain unaffected.
5. Analysis Tools
wiredminds
For marketing and optimisation purposes, we use products and services of wiredminds GmbH (www.wiredminds.de) on this website. In doing so, data is collected, processed and stored from which usage profiles are created under a pseudonym. Where possible and reasonable, these usage profiles are fully anonymised. Cookies may be used for this purpose.
The collected data, which may also contain personal data, is transmitted to wiredminds or collected directly by wiredminds. Without your separately granted consent, it is not used to identify you personally and is not merged with personal data about the bearer of the pseudonym. Where IP addresses are collected, they are anonymised immediately after collection by deleting the last block of digits.
Processing takes place only with your consent (Section 25(1) TDDDG, Art. 6(1)(a) GDPR), which you give via our consent banner and can revoke at any time with effect for the future. We have concluded a data processing agreement with wiredminds.
6. Customer and Contract Data
We collect, process and use personal data only to the extent necessary for the establishment, content, performance or amendment of a contractual relationship (inventory data). This is done on the basis of Art. 6(1)(b) GDPR. In the case of business customers, we process the data of contact persons on the basis of our legitimate interest in conducting the business relationship (Art. 6(1)(f) GDPR).
To process deliveries, we pass on the necessary data to manufacturers, freight forwarders and shipping service providers, and to our bank for payment processing. For the verification of export control requirements, we also process information on end use.
The customer data collected is deleted after completion of the order or termination of the business relationship. Statutory retention periods, in particular under commercial and tax law, remain unaffected. For the transfer to our sister company, see Section 7.
7. Forwarding of Inquiries and Data Exchange with EQ Photonics GmbH
This section applies to all inquiries and business contacts, regardless of the contact channel (website, e-mail, telephone, trade fair).
Sister company
Frankfurt Laser Company cooperates with its sister company:
EQ Photonics GmbH
Zeppelinstr. 4
85399 Hallbergmoos, Germany
E-mail: info@eqphotonics.de
(hereinafter “EQ Photonics”). Both companies distribute photonic components from different manufacturers; which company is responsible depends on the respective manufacturer. Frankfurt Laser Company and EQ Photonics are each independent controllers within the meaning of the GDPR.
Forwarding of inquiries
If your inquiry concerns products or manufacturers that are distributed not by us but by EQ Photonics, we forward your inquiry to EQ Photonics so that EQ Photonics can submit its own offer to you. The data transmitted are your name, your position, your business contact details, the name and address of your company and the content of your inquiry (e.g. technical requirements, quantities, dates).
Exchange of existing customer data
Within existing business relationships, we exchange business contact and master data as well as information on product interests, fields of application and previous inquiries and orders with EQ Photonics, to the extent necessary for the following purposes:
- assignment of an inquiry to the responsible company
- avoidance of duplicate contacts and contradictory offers
- handling of projects in which both companies are involved
- maintenance of up-to-date and correct customer master data
- information about suitable products of the respective other company
What we do not pass on
We do not pass on to EQ Photonics information that is subject to a non-disclosure agreement or that you have marked as confidential. Consents to marketing that you have given us apply only to Frankfurt Laser Company.
Legal basis
The transfer is based on Art. 6(1)(f) GDPR. Our legitimate interest lies in ensuring that your inquiry is processed by the company that offers the desired product and that business relationships within the group of companies are conducted without duplicate contacts (cf. Recital 48 GDPR).
Data we receive from EQ Photonics
If EQ Photonics forwards an inquiry to us or transmits existing customer data to us, we receive the above categories of data from EQ Photonics. We process them for the same purposes and on the same legal basis; in this case, the source of the data is EQ Photonics.
Objection
You can object at any time to the forwarding of your inquiry or to the data exchange with EQ Photonics, including already in your inquiry or by e-mail to sales@frlaserco.com. Your right to object under Art. 21 GDPR (see Section 3) remains unaffected.
Storage period and your rights
The receiving company deletes transmitted data as soon as it is no longer required for the respective purpose; statutory retention periods remain unaffected. You can assert your rights to information, rectification, erasure and restriction against either of the two companies.
